Your personal data is processed in accordance with the Regulation (EU) 2016/679 of the European Parliament and of the Council on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC of 27 April 2016 (the “Regulation”), as well as in accordance with the Act of 10 May 2018 on the protection of personal data (Journal of Laws of 2019, item 1781).

  3. Your personal data may be processed for the following purposes:
    i. presenting offers for the sale of residential or commercial premises via e-mail or telephone contact;
    ii. conducting direct marketing, including sending newsletters;
    iii. sending commercial information;
    iv. making reservations for residential or commercial premises;
    v. concluding and performing reservation, development, or sales agreements;
    vi. responding to your correspondence, complaints, and requests;
    vii. conducting competitions and raffles.

Providing personal data for any of the purposes listed above is voluntary; however, failure to provide such data may result in, among others, the inability to receive offers, newsletters, contact, make reservations, conclude development or reservation agreements, or achieve any of the purposes listed above.
  5. The legal basis for processing personal data for the purposes indicated above is:
    i. performance of a contract or taking steps at your request prior to entering into a contract – Article 6(1)(b) of the Regulation;
    ii. consent given by you – Article 6(1)(a) of the Regulation;
    iii. compliance with legal obligations applicable to the Data Controller – Article 6(1)(c) of the Regulation;
    iv. the legitimate interest of the Data Controller – Article 6(1)(f) of the Regulation; the legitimate interest may include processing personal data to establish, pursue, or defend claims arising from concluded agreements.
  6. Recipients of your personal data, apart from the Data Controller, may include authorized entities, employees, and cooperating parties (e.g., providers of construction and renovation services, IT services, auditors, notaries, banks, entities providing accounting, IT, or marketing services) who need access to the data in connection with the purposes specified in point 3 above.
  7. The period during which your personal data will be processed depends on the purpose for which the data were collected:
    i. in the case of individuals interested in purchasing real estate from the Data Controller’s offer, in connection with the necessity to take actions at the request of the person whose data are processed – for no longer than 3 years from the date of the request;
    ii. in the case of individuals who have consented to the processing of their personal data – for the period necessary to achieve the intended purpose, but no later than until the withdrawal of consent;
    iii. in the case of individuals who are parties to an agreement concluded with the Data Controller – at least until the limitation period for claims of each party or for the period specified in generally applicable laws.
  8. You have the right to access your data, rectify them, erase them, restrict processing, and the right to object to processing.
  9. If personal data is processed based on your consent, you have the right to withdraw your consent at any time without affecting the lawfulness of processing carried out on the basis of consent before its withdrawal.
  10. You have the right to lodge a complaint at any time with the President of the Personal Data Protection Office.
  11. The Data Controller does not use automated decision-making systems and does not perform profiling based on personal data.
